La consulta previa como fundamental de titularidad colectiva de los pueblos ?tnicos, se constituye en un instrumento de defesa de no solo del territorio de las minor?as ?tnicas, sino en un instrumento, derecho fundamental y derecho humano que propicia la defensa de otros derechos b?sicos de la comunidad y de sus miembros como la cultura, creencias, integridad personal, seguridad alimentaria y pervivencia misma, para ello la consulta previa deber?a convertirse en un derecho efectivo de protecci?n material y no un derecho de protecci?n meramente formal. Hacer del derecho a la consulta previa un mecanismo o derecho de protecci?n ?nicamente formal, se constituir?a en un instrumento de negaci?n de otros derechos protegidos en la Constituci?n pol?tica de Colombia y en instrumento internacionales como la convenci?n americana de derechos humanos, por ello en este articulo buscando generar un documento que motiva la transformaci?n de este instrumento jur?dico de protecci?n formal a convertirse en un instrumento de protecci?n efectiva, de protecci?n material de derechos, en distintos ordenamientos jur?dicos.
Prior consultation, as fundamental to the collective ownership of ethnic peoples, constitutes an instrument of defense of not only the territory of ethnic minorities, but also an instrument, a fundamental right and a human right that fosters the defense of other basic rights of the community and its members such as culture, beliefs, personal integrity, food security and survival itself, for this, prior consultation should become an effective right of material protection and not a merely formal right of protection. Making the right to prior consultation a mechanism or only formal right of protection would constitute an instrument for the denial of other rights protected in the Colombian police constitution and in international instruments such as the American Convention on Human Rights, therefore in this article seeking to generate a document that motivates the transformation of this legal instrument of formal protection to become an instrument of effective protection, of material protection of rights, in different legal systems.
