El presente art?culo tiene como prop?sito, introducir una figura penal sobre la cual la doctrina es escasa respecto de las experiencias nacionales e inclusive en otras latitudes de nuestra ?rea continental, siendo probablemente, la experiencia en Estados Unidos una de las m?s enriquecedoras, desde un enfoque acad?mico, sin embargo, es una figura existente en nuestro C?digo Penal, t?cnica e interesante, donde para su configuraci?n y prueba, se conjugan perfectamente lo jur?dico con las ciencias forenses. No obstante, es necesario con antelaci?n adentrarse en el sistema en el cual ocurre, siendo este el sistema financiero, y adem?s, el mercado espec?fico, es decir, el mercado de valores, el cual cada vez tiene un impacto positivo mayor en la econom?a del pa?s y que representa un medio alternativo para el desarrollo financiero de los inversionistas, quienes deben ser tutelados, sumado al mercado en el cual se desarrollan.
