El rol investigador de la defensa t?cnica en el proceso penal acusatorio

Description: En Panam?, durante la vigencia del proceso penal inquisitivo mixto, la direcci?n de la investigaci?n y el ejercicio de la acci?n penal era facultad de la representaci?n social, esto es, el Ministerio P?blico, quien realizaba los actos de investigaci?n para acreditar su teor?a del caso. Con la promulgaci?n del nuevo sistema procesal penal, oral, adversarial y garantista, el defensor t?cnico adquiere un sitial protag?nico en el rol investigativo, basado en la libertad de investigaci?n y presentaci?n de medios de prueba, para ello requiere la adopci?n de competencias que faciliten el efectivo ejercicio de la defensa en la fase investigativa.
In Panama, during the validity of the previous criminal process, the direction of the investigation and the exercise of the criminal action was the power of the social representation, that is, the Public Ministry, who carried out the acts of investigation to prove its theory of the case. With the promulgation of the new criminal, oral, adversarial and guarantor procedural system, the technical defender acquires a leading role in the investigative role, based on the freedom of investigation and presentation of evidence, for which he requires the adoption of skills that facilitate the effective exercise of the defense in the investigative phase.
