Los delitos contra la administraci?n p?blica, en la fase de investigaci?n del proceso penal acusatorio

El poder punitivo del Estado se manifiesta de diferentes maneras, entre las cuales est? el obligatorio cumplimiento de la normativa penal, que dispone diversas conductas humanas que delimita los hechos que de ser cometidos, acarrear? la aplicaci?n de una sanci?n; no obstante, este poder no es omnipotente, sino limitado a ciertos principios que justifican precisamente el Estado de Derecho y las garant?as fundamentales de los asociados. Ahora bien, incluso el derecho penal debe intervenir ?nicamente ante la agresi?n grave de un bien jur?dico protegido o ante la imposibilidad de utilizar otros mecanismos de control social menos gravosos, lo que guarda relaci?n con los principios de subsidiariedad y fragmentariedad, as? como de su car?cter de ?ltima ratio, conforme al art?culo 3 del C?digo Penal. Una conducta para ser catalogada ?punible!?, debe estar previamente descrita como delito y ajustarse a su tenor literal, tal como lo precept?a el art?culo 12 de dicha excerta legal. Los Delitos Contra la Administraci?n P?blica configuran conductas delictivas normadas en nuestro C?digo Penal, cuya finalidad radica en la protecci?n del buen funcionamiento de las labores y deberes que se atribuyen a determinadas personas, a saber, los funcionarios o servidores p?blicos, quienes administran las arcas del Estado. Cada una de estas conductas tipificadas en el C?digo Penal destinadas a castigar la mala administraci?n de la cosa p?blica, debe ser analizada desde el prisma de la tipicidad, conforme al principio de legalidad estipulado en el art?culo 31 de la Constituci?n Pol?tica de la Rep?blica de Panam?. Ante la noticia criminal por la presunta comisi?n de uno de estos hechos punibles, el Ministerio P?blico debe adoptar toda una gama de estrategias y t?cnicas de investigaci?n novedosas, que permitan acreditar el aspecto objetivo y subjetivo del mismo, a saber, el delito y la vinculaci?n de un servidor p?blico al mismo, o en ocasiones un particular.
The punitive power of the State is manifested in different ways, among which is the mandatory compliance with criminal regulations, which provides various human behaviors that delimit the facts that, if committed, will result in the application of a sanction; However, this power is not omnipotent, but limited to certain principles that justify precisely the rule of law and the fundamental guarantees of associates. However, even criminal law should only intervene in the face of the serious aggression of a protected legal good or the impossibility of using other less burdensome social control mechanisms, which is related to the principles of subsidiarity and fragmentation, as well as its character of last ratio, in accordance with article 3 of the Criminal Code. A conduct to be classified as ?punishable!? Must be previously described as a crime and conform to its literal wording, as prescribed by article 12 of said legal excess. The Crimes Against the Public Administration configure criminal behaviors regulated in our Criminal Code, whose purpose lies in the protection of the proper functioning of the tasks and duties attributed to certain persons, namely, public officials or servants, who administer the coffers of the State. Each of these behaviors typified in the Criminal Code aimed at punishing the mismanagement of the public thing, must be analyzed from the perspective of typicality, in accordance with the principle of legality stipulated in article 31 of the Political Constitution of the Republic of Panama. Before the criminal news for the alleged commission of one of these punishable acts, the Public Prosecutor?s Office must adopt a whole range of innovative investigation strategies and techniques, which allow to prove the objective and subjective aspect of it, namely the crime and the connection from a public server to it, or sometimes a private one.
